JEFFERSON CITY, Mo. - In a recent decision, the Missouri State Supreme Court affirmed the denial of postconviction relief for a St. Joseph man who was convicted of second-degree domestic assault and armed criminal action.
Shawn Flaherty argued his trial counsel was ineffective for not requesting a lesser charge of fourth-degree domestic assault. The court ruled that while counsel’s performance was deficient, it did not prejudice Flaherty’s case.
Flaherty’s convictions stem from a 2018 incident where he brandished a revolver during an argument with his wife, leading to her being shot in the knee.
The court upheld his seven-year and three-year consecutive sentences, concluding that the trial court’s judgment was not clearly erroneous.
